Ms. Treistman's significant current and past representative matters include:
  • In 2009, prosecuting for minority shareholders a multi-million dollar dispute with NL Industries, involving its improper depletion of company stock to artificially reduce the value to be paid minority shareholders as compensation for sale of their company stock. View press release.
  • In October 2008, successfully obtained a TRO against defendants before Judge Hittner for a private equity firm, suing defendants for breach of contract and tortious interference, arising out of defendants' attempt to destabilize the plaintiff's company. Upon one of the defendant's departure as President of the plaintiff's company, that defendant joined a financial institution and persuaded another defendant to violate his employment agreement with the plaintiff, by taking its confidential information and using it to solicit clients on its behalf.
     
  • CEMEX in various disputes, involving breach of contract and construction issues in El Paso, Texas.
     
  • Construction company in its multi million dollar dispute against Con Edison Communications, pending in New York state court. Trial will be set for the Spring-Summer 2009.
     
  • Successful settlement, weeks prior to commencement of a lengthy and hotly contested arbitration proceeding for Exterran, Inc. formerly known as Universal Compression, Inc. in an arbitration with CenterPoint Energy, concerning breach of compressor monitoring and compression contracts.
     
  • Represented a NASDAQ life sciences technology company in a professional malpractice case against the firm's prior outside auditors based on their negligent work in connection with our client's IPO and SEC registration. We settled the case on favorable terms on the eve of one of the client's depositions. At the defendant's insistence, the identity of the parties and the amount of settlement are confidential.
     
  • Successful confidential settlement after commencement of trial, in representation of LunarEye Inc. in patent infringement and other claims against British Petroleum and Independent Witness Inc. in the Eastern District of Texas (Judge Clark).
     
  • Successful confidential settlement prior to trial of a patent infringement case against American Express Corp. in the Eastern District of Texas (Judge Ward).
     
  • Toronto Dominion v. PricewaterhouseCoopers. Represented more than ninety banks and other financial institution in connection with their claims against Pricewaterhouse Coopers, alleging that the plaintiffs provided a $2.1 billion credit facility to a company called Laidlaw Environmental Services Inc, later known as Safety-Kleen, in reliance on PwC audited and certified financial statements for the company.   • Patent holders, such as LunarEye Inc. in patent infringement and other claims against British Petroleum and Independent Witness Inc. in the Eastern District of Texas (Judge Clark) and patent holders against American Express Corp. in the Eastern District of Texas (Judge Ward). 
  • Hilcorp Energy Co. in a confidential arbitration proceeding, involving a sale of oil and gas properties in Louisiana. Following a hearing on the merits, our client prevailed on every issue in the arbitration.
     
  • Universal Compression, Inc. in state and federal courts nationwide in breach of contract disputes, relating to sales of gas compressors.
     
  • Defense of a class action and mass action, involving alleged injuries from an ammonia leak in Louisiana state court.
     
  • Prosecution of accounting malpractice case against a nationally prominent accounting firm, along with related fraud claims against financial institution defendants.
     
  • Duramed Pharmaceuticals, Inc. v. Wyeth-Ayerst Laboratories. Represented plaintiff Duramed in this lawsuit alleging monopolization of the market for estrogen replacement and hormone replacement drugs. Among other accomplishments, responsible for defeating a motion to dismiss all plaintiff's claims, filed by defendant. The parties reached a confidential settlement providing favorable terms for Duramed.
     
  • Enron Corp: Represented Enron in a derivative shareholder class action claim. Case dismissed by agreement after SG's filing of Rule 13 motion, seeking dismissal for groundless case.
