- Poly-America LP v. Stego Industries, L.L.C. Lead counsel for plaintiff in this trademark invalidity action. Result: Court found for plaintiff on its trademark invalidity action, declared the trademark invalid, ordered cancellation of the trademark, and enjoined defendant from initiating or pursuing infringement litigation against plaintiff or its customers, dealers, agents or employees based on the federally registered trademark or any claimed common law rights related thereto. Stego appealed its loss in the district court. After hearing oral argument, the Fifth Circuit affirmed.
- Cannon Interests-Houston v. Kinder Morgan Texas Pipeline, L.P. Lead counsel for plaintiff in this approximately $15 million dollar breach of contract claim. Result: Won three motions in a row prompting a favorable settlement.
- Lyondell-Citgo Refining LP v. Petroleos de Venezuela, SA and PDVSA-Petroleo, S.A. Counsel for plaintiff in this $250 million dollar breach of contract action. Result: Settled after we obtained an adverse inference against the defendants for refusing to produce documents and while plaintiff's motion for summary judgment was pending.
- Spanish Broadcasting Systems, Inc. v. Clear Channel Communications, Inc. and Hispanic Broadcasting Corporation. Counsel for defendant in this $1.5 billion antitrust action. Result: Obtained both a dismissal of the action in the lower court and affirmance of that decision in the Eleventh Circuit.
- DeGeorge v. Residential Funding Corporation. Counsel for plaintiff in this financial fraud case. Result: Settled on remand after winning reversal from the Second Circuit Court of Appeals of a $96 million judgment against our client.Wyeth v. Ace Bermuda Insurance Ltd. Counsel for defendant in this $150 million dollar breach of contract dispute. Result: Obtained winning judgment for defendant after three week international arbitration.
- Bussian et al v. RJR Nabisco, Inc. Counsel for pensioners in this ERISA action. Result: Settled after winning appeal before Fifth Circuit.
- Luna v. Poly-America, Inc. Lead counsel for defendant in this wrongful termination case. Result: Win in the district court and again before the Texas Supreme Court.
- Dalton v. Maroon Bells. Counsel for plaintiff in this executive compensation dispute. Result: Settled immediately after opening statement at trial.
