"I've worked closely with lawyers for more than thirty years. You are among the very best attorneys I've had the pleasure of working with. . . . Your skill in sorting through complex scenarios and finding applicable law, and quickly providing options and recommendations, is among the very best I have seen. Perhaps more than these qualities, I am most impressed by your good judgment and aptitude for providing a clear view of strategic choices, even when the environment for decision-making is hostile and heated." As a partner with Susman Godfrey LLP, Ms. White represents plaintiffs and defendants in complex commercial cases of all types. She has successfully handled cases involving intellectual property, antitrust, breach of contract, fraud, labor and employment, shareholder disputes, insurance coverage, professional malpractice, and numerous mass and class actions. In 2009, Ms. White successfully argued that the Federal Circuit should make new law for her client, Sky Technologies, in a complicated patent ownership dispute.  The decision was profiled in several leading publications, and spawned a series of seminars highlighting its significance for those who deal with intellectual property.

At the trial level, Ms. White has handled high-profile cases throughout Texas and beyond – including in Massachusetts, Wisconsin, New York, New Jersey, Louisiana, the District of Columbia and California. In the past four years, she has recovered more than a hundred million dollars for clients in cases where she represented plaintiffs, and defeated claims seeking multiples more when representing defendants.  Several of her cases have been featured in Business Week, The American Lawyer, and Law 360, and she has been recognized as a "Rising Star" and a "Professional on the Fast Track" by Texas Monthly, Texas Law & Politics and H Texas Magazine. She has developed a growing and loyal following of clients and co-counsel who consistently call her to handle both their routine and their "bet the company" litigation. She derives great satisfaction from exceeding her clients' expectations in terms of the result obtained and the cost of achieving it.

Representative cases include:
  • Successfully represented Boston-based technology licensing firm, Sky Technologies, in patent infringement litigation spanning five defendants and multiple courts in Massachusetts, the District of Columbia, and Texas. As a result of Ms. White's efforts, global software behemoth, IBM, agreed to license Sky's patents and technology for conducting online negotiation two days before the parties were set to pick a jury. (Read more about the case here).  Ms. White settled similar litigation against software maker Ariba, Inc. only two trial days after she delivered an opening statement persuasively outlining Sky's infringement proof to a Boston jury. (Read more about the case here). Ms. White has successfully concluded similar litigation against Oracle, i2 Technologies, and Procuri, and continues to represent the company in related patent litigation against SAP. All settlement amounts are confidential.
  • Successfully represented Milwaukee County and the Milwaukee County Pension System in a highly publicized actuarial malpractice case against the largest actuarial firm in the country. The dispute involved allegations of professional negligence by Mercer, Inc., a subsidiary of Marsh & McLennan Companies. Mercer denies the allegations, but agreed to pay Milwaukee County $45 million to settle the case.  The settlement is reported to be the largest recovery by a public government entity in Wisconsin history, and one of the largest recoveries relating to allegations of actuarial negligence in the United States. (More about the case here.)
  • Successfully represented a consortium of approximately fifty nationwide health payors in lawsuits filed against a variety of defendants in state and federal courts in New Jersey and Louisiana. The complaints asserted state law claims against Merck & Co. arising in connection with the marketing and sale of Vioxx®, and asserted healthcare reimbursement liens against a $4.85 billion fund established to compensate for Vioxx-related injuries. In January 2009, the clients reached a groundbreaking settlement with the Vioxx Plaintiffs' Steering Committee, guaranteeing them certain payouts on their liens covering participating plaintiffs. The American Lawyer featured this litigation and its settlement in the "Big Suits" column of its April 2009 issue.
  • Successfully defended and obtained take-nothing judgment on behalf of Texas energy company in a multi-million dollar arbitration proceeding arising from the packaged sale of certain Louisiana oil and gas properties.
  • Obtained highly favorable settlement on behalf of two South American pipeline companies in a lawsuit filed in Texas state court against their insurance brokers alleging negligent failure to procure contingent business interruption insurance. The amount of the settlement is confidential.
  • Obtained summary judgment for the plaintiff, a privately held energy company, in a lawsuit alleging that its insurer breached a duty to defend the company against litigation filed by a third party. The case settled for a confidential sum.  Ms. White successfully concluded similar litigation on behalf of Nokia, Inc., after the Texas Supreme Court likewise decided in favor of Nokia and the duty to defend.
  • Currently representing the plaintiffs in a multi-billion dollar class action antitrust lawsuit against Citgo Petroleum Corporation filed in U.S. District Court for the Southern District of Texas. The complaint, brought under Section 1 of the Sherman Act and Sections 4 and 16 of the Clayton Act, alleges that Citgo actively has participated in OPEC's illegal price-fixing conspiracy, has provided unlawful assistance to OPEC, and has implemented Venezuela's and OPEC's price-fixing scheme in the United States.Read More
  • Currently representing defendants in a shareholder dispute alleging $150 million in damages. The suit is pending in a Texas state court, with trial scheduled for October 2010.
