Susman Godfrey Again Persuades Judges to Recommend Denial of Las Brisas Permit

Austin, Texas — On December 1st, two Administrative Law Judges recommended that the Texas Commission on Environmental Quality deny the air permit application of Las Brisas Energy center, which had sought to build a pet coke-fired power plant within 5 miles of downtown Corpus Christi.

Two Susman Godfrey L.L.P. partners — Terry Oxford of Dallas and Drew Hansen of Seattle — played significant roles in the team of protesters to the permit. Citing evidence developed by Oxford and Hansen, the Judges said that Las Brisas’ own air modeling was insufficient and that the Commission staff improperly assisted Las Brisas in meeting its burden.

The Commission will decide whether or not to accept the Judges’ recommendation.
