HIGH STAKES LITIGATION
Eliza was part of a team of lawyers who won a $287 million jury verdict on behalf of Dutch telecommunications company Koninklijke KPN N.V. (KPN) in a breach of contract dispute with Samsung Electronics Co. A Texas state court jury returned the verdict after four days of trial and just over three hours of deliberation. Leading up to trial Eliza led deposition efforts, drafted successful oppositions to Samsung’s motion for summary judgment and motion to exclude her side’s damages expert, and successfully excluded portions of testimony by Samsung’s experts. Eliza represented Sol IP in its patent infringement litigation against AT&T, Sprint, and Verizon in the Eastern District of Texas. The matter settled one month before trial due in large part to critical information obtained by Eliza while leading deposition efforts.
Eliza is now serving as counsel to a certified class of plaintiffs in In re: NFL Sunday Ticket Antitrust Litigation. Eliza’s team previously obtained a victory after 3 weeks of trial with a jury finding the NFL engaged in a conspiracy and violated the antitrust laws through its Sunday Ticket offering. The jury awarded $4.7 billion damages, which the trial court vacated on a post-trial motion, while leaving untouched the jury’s determination that the NFL violated two different provisions of the Sherman Act. The case is currently on appeal.
Eliza is also defending Renalogic, Inc. and Anchor Benefit Consulting in a lawsuit filed in Florida state court by various Fresenius entities alleging tortious interference in business relations. Eliza has played a significant role in taking and defending depositions and developing case strategies. She also served as second chair during a two-week bench trial and conducted direct and cross exams of key witnesses.
