Overview

Nick Carullo litigates complex legal matters in courtrooms across the nation. He has represented clients at all stages of litigation, from state and federal trial courts, to the highest state courts of appeal, to the United States Supreme Court.

Having been involved in some of Susman Godfrey’s most high-profile litigation matters, Nick has established himself to be a savvy trial lawyer with the ability to take on cases across a diverse cross section of practice areas and industries.

LANDMARK RESULTS

Nick served as counsel to Black Knight Servicing Technologies in a six-week misuse of confidential information, trade secret, and antitrust arbitration against PennyMac Loan Services. The proceeding resulted in a nearly $160 million award for Black Knight, which was confirmed by a Florida state court in 2024. Nick played a pivotal role at the arbitration, including handling multiple witnesses at trial on both sides of the case, presenting Black Knight’s main liability expert on theft of confidential information and trade secrets, and conducting the cross examination of PennyMac’s antitrust damages expert who was offered to support its counterclaim. 

In a hotly followed defamation matter, Nick represented acclaimed hedge funder, Louis Bacon, in his highly-publicized litigation against fashion magnate, Peter Nygard. In 2023 Nick and his team secured a $203 million win from Supreme Court of the State of New York, County of New York on behalf of Bacon – believed to be the highest defamation judgment in New York state history. Nick secured a summary judgment win for plaintiffs in the class action, Vida Longevity Fund v. Lincoln Life & Annuity Company of NY, pending in SDNY.  Nick represents a class of life insurance policyholders alleging tens of millions of dollars in damages after Lincoln overcharged them for the cost of insurance.  Nick has played a leading role in the case, taking and defending every deposition and principally drafting each brief. Nick’s work here had a direct impact on defeating the Defendant’s motion for summary judgment, paving the way for trial.

In Moore Charitable Foundation v. PJT Partners Nick won a reversal of the dismissal of his client The Moore Charitable Foundation’s negligent supervision claim at the New York Court of Appeals. That decision helped to clarify the New York law relating to how duty extends in negligent supervision cases.  Nick was the principal drafter of the briefs in this matter, before both the First Department and the New York Court of Appeals.

PRO BONO

Despite his robust docket, Nick makes it a priority to do pro bono work, representing those who cannot afford legal assistance. Nick served as Court-appointed pro bono counsel in S.D.N.Y. for an excessive force case under §1983.  His team obtained a favorable settlement for their incarcerated client the night before trial. 

BACKGROUND

Nick joined Susman Godfrey after clerking for Judge Gregg Costa on the United States Court of Appeals for the Fifth Circuit.  He earned his J.D. Order of the Coif from the University of Virginia School of Law, where he was a Notes Editor on the board of the Virginia Law Review, and he graduated with Distinction from the University of Virginia, where he majored in Foreign Affairs and Italian Studies.

  • Black Knight, Inc. v. PennyMac Loan Services, LLC (Florida Arbitration) Secured a nearly $160 million arbitration award on behalf of Black Knight Servicing Technologies after a six-week misuse of confidential information, trade secret, and antitrust arbitration against PennyMac Loan Services.
  • Louis Bacon v. Peter Nygard et al. (New York Supreme Court, Commercial Division) Delivered the closing argument leading to a $203 million award for Louis Bacon in a high-profile defamation case against Peter Nygard.   • Langer v. CME Group, Inc. (Circuit Court Of Cook County, Illinois County Department, Chancery Division) Serving as counsel for individual plaintiffs and a certified class of members of the Chicago Mercantile Exchange and the Chicago Board of Trade. The billion-dollar case alleges that CME and CBOT breached their most fundamental obligations to members under the exchanges’ respective corporate charters, including by opening an electronic trading floor without required member approval.  Additional information about the case is available here.
  • Polansky v. Executive Health Resources (United States Supreme Court) Represented a whistleblower in a multibillion-dollar dispute under the False Claims Act before the United States Supreme Court.
