Overview

Scott Glass represents plaintiffs and defendants—and secures winning results—in complex commercial litigation across the United States. Scott has litigated cases across a variety of practice areas, including antitrust, breach of contract, complex business disputes, environmental, insurance, and intellectual property. Scott’s client list is equally diverse, ranging from Fortune 500 companies to smaller businesses and individuals.

Scott takes an active role in all his matters, with a focus on helping his clients achieve their goals. Scott has argued critical motions, taken and defended dozens of depositions, and been the primary drafter on numerous briefs submitted to courts and tribunals across the country.

WINS AND HIGH-PROFILE WORK

Scott represents Focus Financial Partners—which partners with independent wealth- and business-management firms—in major litigation brought by partner, KSFB. In a far-reaching case in the New York Commercial Division involving claims of breach of fiduciary duty, breach of contract, fraud, tortious interference, and unjust enrichment, the court granted Scott’s team’s motion to dismiss in full after Scott took a lead role in crafting the winning brief and argued a portion of the motion. (Read more here and here.) Scott has also played a central role in a separate and ongoing case in California state court involving claims related to a non-compete covenant.

Scott recently represented NBCUniversal Media, LLC in a confidential arbitration against two of its insurance carriers. Scott played an essential role in the case from its inception, including by crafting the pleadings, briefing important legal issues, taking and defending depositions, and shepherding expert discovery. Scott and the lean Susman team achieved a favorable result for NBCUniversal in the weeks before the arbitration hearing was set to begin.

Scott is currently defending Chevron in more than forty lawsuits filed by coastal Louisiana Parishes relating to the loss of marsh land. Playing a pivotal role in these matters, Scott has taken and defended critical depositions, and he also been a primary drafter of significant briefing in both federal and state court. Scott’s team is currently preparing for trial in Louisiana state court in one of these cases.

Scott serves as counsel for MyPAQ in patent-infringement cases pending in federal court in Waco against Samsung, Dell, and Anker. Scott has taken a leading role in these cases including by briefing crucial motions, taking key depositions, and successfully arguing terms at the Markman hearing.

Scott also represents more than two dozen plaintiffs in In re Rail Freight Fuel Surcharge Litigation, an antitrust MDL pending in federal court in Washington, D.C., who allege the nation’s four largest freight railroads conspired to fix the price of rail freight services through coordinated rate-based fuel surcharges. Scott has handled material depositions in these matters and made vital contributions to briefing on dispositive motions.

BACKGROUND

Scott joined Susman Godfrey after clerking for Judge Jerry E. Smith of the U.S. Court of Appeals for the Fifth Circuit and Judge Loretta A. Preska of the U.S. District Court for the Southern District of New York. He graduated from Columbia Law School, where he received the Ruth Bader Ginsburg Prize (for earning James Kent academic honors each year) and served as an Articles Editor for the Columbia Law Review.

Before law school, Scott spent three years as an auditor at a Big Four accounting firm, and he was a licensed CPA. Scott earned his undergraduate degree in Business Administration from Bucknell University, where he was also a member of the baseball team.

Notable Representations

  • KSFB Management, LLC v. Focus Financial Partners, LLC (N.Y. Comm. Div. & Cal. Super. Ct.) Counsel for Focus in lawsuits in the N.Y. Commercial Division and Los Angeles Superior Court brought by partner KSFB. Scott and the small SG team secured a complete dismissal of the New York case. The California case, which concerns the enforceability of a non-compete covenant, remains pending.
  • NBCUniversal Media LLC v. Insurance Carriers (AAA Arbitration) Secured a favorable result for NBCUniversal in a confidential arbitration with its insurance carriers.
  • Litigation on Behalf of Chevron (E.D. La., Cameron, Plaquemines, Vermillion, St. Bernard, Orleans, & Jefferson Parishes) Counsel for Chevron in more than forty lawsuits filed by coastal Louisiana parishes and the State of Louisiana related to the loss of marsh land and other damages to Louisiana’s coastal zone allegedly caused by historical oil-and-gas operations. The cases are pending in various Louisiana state and federal courts.
  • In re Rail Freight Fuel Surcharge Antitrust Litigation (D.D.C.) Counsel for more than two dozen plaintiffs who allege that the four largest American freight railroads (BNSF, CSX Transportation, Norfolk Southern, and Union Pacific) violated US antitrust laws by conspiring to fix prices by imposing rate-based fuel surcharges.
  • MyPAQ v. Samsung, Dell, and Anker (W.D. Tex.): Counsel for MyPAQ in three patent-infringement cases related to the sale of high-speed travel chargers.
