Tom Boardman

Tom Boardman is a leading antitrust attorney with more than fifteen years of high-stakes litigation experience. His practice focuses on complex antitrust and commercial disputes, with experience at every stage of litigation, including trial and appeal.  

His current representations reflect the breadth of his practice. In Index Exchange and Kargo v. Google, Tom represents two leading advertising technology companies in antitrust litigation alleging that Google unlawfully monopolized the market for open-web display ad exchanges through unlawful tying, auction manipulation, and other exclusionary practices designed to suppress rival exchanges. In Chegg v. Google, Tom represents the online educational publisher in vanguard antitrust litigation alleging that Google unlawfully maintained and exploited its monopoly in general search services by appropriating educational publisher content supplied for search indexing to operate AI-generated search-result overviews and other non-search features. In In re MultiPlan Health Insurance Provider Litigation, Tom was appointed one of the lead counsel attorneys to represent a proposed class of healthcare providers alleging that MultiPlan and insurance companies fixed reimbursement rates for out-of-network services. In Bausch & Lomb v. Gemini Insurance Co. et al., Tom represents Bausch + Lomb in a Louisiana state-court action against a tower of insurers for breach of contract and bad-faith denial of coverage under representations-and-warranties insurance policies issued in connection with an acquisition.

Over his career, Tom has played key roles in some of the country’s most significant antitrust cases. He served as a member of co-lead counsel for consumer and institutional-investor classes in litigation involving alleged price fixing in the contact-lens, government-sponsored bond, and foreign-exchange markets. His work has included taking and defending executive-level and expert depositions, leading discovery negotiations, presenting discovery disputes to courts, briefing and arguing summary judgment, developing damages theories with expert economists, and serving as the principal author of appellate briefs. Early in his career, Tom was part of the trial team that secured a favorable jury verdict in In re TFT-LCD (Flat Panel) Antitrust Litigation and worked on landmark challenges to NCAA restrictions, including preparing prominent former athletes like Bill Russell and Oscar Robertson for depositions and helping develop the complaint and economic theory in Alston v. NCAA.

Tom also has substantial trial and broader complex-litigation experience. As a member of the trial team representing the City of Baltimore in litigation against pharmaceutical opioid manufacturers and distributors, he helped secure over $400 million in settlements and a unanimous $266 million jury verdict against the two remaining defendants. At trial, he presented an expert economist and prepared City witnesses and experts to testify; during discovery, he took depositions of defense medical experts and had primary responsibility for preparing and defending City witness depositions. Tom has also represented a multinational healthcare company in litigation concerning the alleged health effects of a chemical used to sterilize medical instruments, working closely with company personnel and counsel on document and data preservation and leading third-party discovery efforts.

Before joining Susman Godfrey, Tom was a partner at Scott+Scott and began his legal career clerking for Judge Christina Reiss of the U.S. District Court in his home state of Vermont. Tom earned his J.D. from the University of California College of the Law, San Francisco, where he served on the Hastings Science and Technology Law Journal and worked as a research assistant to Prof. Geoffrey Hazard, Jr. He received his B.A. from Vassar College. Tom is admitted to practice in New York and California, as well as before the U.S. Courts of Appeals for the Second and Ninth Circuits and federal district courts in both states. His accomplishments have been recognized by the American Antitrust Institute, Best Lawyers, Super Lawyers, and Consumer Attorneys of California. He has also volunteered with the Florida Rights Restoration Coalition, working directly with formerly incarcerated citizens seeking restoration of their voting rights. In his free time, Tom enjoys running in the streets and parks of New York City and is a founding member of the Glue Factory Track Club.
