Partners Geoffrey Harrison and Alex Kaplan successfully represented Chevron Phillips Chemical LP in a multi-million dollar breach of contract suit against an international freight forwarding company. We argued to the jury that the freight forwarding company failed to comply with the parties’ written contract by charging substantial foreign exchange related fees on international shipments that we claimed were not permitted by the contract. Before trial, we persuaded the court to grant a plaintiff-side partial summary judgment in our client’s favor on liability, and also to grant summary judgment against defendant’s counterclaims. The jury trial took place on the issues of defendant’s affirmative defenses and the amount of damages we were owed. We settled the case at the end of the first week of trial, shortly after we called our corporate representative and called one of the defendant’s key executives as an adverse witness in our case. The terms of the settlement are confidential.
