Overview

Alex Foulkes Grafton joined Susman Godfrey after clerking on the U.S. Court of Appeals for the Fifth Circuit for Judge Carolyn Dineen King and on the U.S. District Court for the Western District of Oklahoma for Chief Judge Timothy D. DeGiusti.

Alex is serving as counsel to clients, including a major international bank, in matters relating to the impact of the February 2021 winter storms in Texas and Oklahoma. These cases involve both natural gas and power, specifically the ERCOT market, and are pending in New York federal court and various state courts in Texas. Related issues include force majeure, natural gas and energy pricing and various states’ laws. Alex is also counsel to dozens of rail-freight shippers in a high-profile antitrust case concerning alleged fuel-surcharge collusion among the nation’s largest rail-freight carriers.

Alex has also worked pro bono, partnering with the Texas Civil Rights Project on briefing petitions for certiorari to the United States Supreme Court on Ex parte Young, and litigating the constitutionality of state laws and alleged violations of the Ku Klux Klan Act, 42 U.S.C. § 1985(3).

BACKGROUND

Alex graduated first in her class from the University of Houston Law Center, where she served as Chief Articles Editor for the Houston Law Review. During law school Alex interned for Judge Gray H. Miller of the United States District Court for the Southern District of Texas and worked with Baylor College of Medicine’s Center for Medical Ethics and Health Policy on research related to the legal and ethical implications of new biomedical technologies in neuroscience and genomics.

Before law school, Alex was a neuroscientist for Baylor College of Medicine, researching cognitive genomics and novel treatments in psychiatry.  Alex has a master’s degree in neuroscience from University College London and an undergraduate degree in theology and biology from the University of St. Thomas. 

Born and raised in Mexico City, Alex is fluent in Spanish.
