Amy Gregory

Amy Gregory litigates high-stakes disputes in federal and state courts across the nation. Her expertise is diverse. Amy has litigated cases relating to antitrust, breach of contract, the False Claims Act, and intellectual property among several other complex practice areas. Likewise, Amy’s clients range from large companies to small businesses and individuals in large class actions.

RESULTS

Amy has contributed to several major legal wins.

Amy helped secure a $19 million settlement with Laboratory Corporation of America on behalf of two whistleblower clients in a landmark False Claims Act case. Her clients alleged that the lab testing giant was part of a conspiracy to pay kickbacks to doctors in order to persuade the doctors to order blood tests. Amy led efforts on briefing the summary judgment opposition and several key discovery issues. In Leonard v. John Hancock Life Insurance Co., Amy represented a proposed class of insurance policy owners over allegations of breach of contract and false illustrations. Amy took several critical depositions of John Hancock’s witnesses, including its Chief Actuary, eliciting information that was central to the outcome of the case. The parties reached a class-wide settlement of $93 million in cash, before fees and expenses, plus non-cash benefits valued at up to $50.48 million, including a cost of insurance freeze for five years.

Amy served as trial counsel to Van Leeuwen Ice Cream in a Lanham Act trade dress infringement lawsuit against Rebel Creamery pending in the Eastern District of New York. Over the course of the four-day trial, Amy put on five witnesses, including direct and cross-examining key fact and expert witnesses. Her team is awaiting results.

Amy now represents a proposed class of victims who allege that MindGeek has violated state and federal sex trafficking and child pornography laws by knowingly receiving, distributing, and profiting from thousands of videos and images depicting child sexual abuse material. Amy led the briefing on opposing MindGeek’s motion to dismiss, which the court denied on the basis that Section 230 did not bar the claims – a huge win for her clients (read the court opinion here). Amy also led efforts to brief class certification and ultimately played an instrumental role in the class getting certified.

BACKGROUND

Amy joined Susman Godfrey after clerking for Judge Dennis Jacobs of the United States Court of Appeals for the Second Circuit.  Before clerking, she practiced commercial litigation at another leading firm.  Ms. Gregory graduated magna cum laude and Phi Beta Kappa from Georgetown University.  She earned her J.D.  from Columbia Law School, where she was a Notes Editor on the board of the Columbia Law Review.
