Susman Godfrey Secures Complete Defense Victory for Globus Medical in Spinal Device Patent Infringement Suit

HOUSTON (August 22, 2016) — Susman Godfrey LLP secured a complete victory in Tyler, Texas, on behalf of client Globus Medical in spinal insert patent infringement litigation brought by Flexuspine, Inc., a local Tyler company. On Friday, August 19, a jury in the U.S. District Court for the Eastern District of Texas issued a defense verdict entirely in Globus Medical’s favor.

“We are pleased by this victory that makes it clear that Globus Medical’s innovative products are the product of its engineers’ own creative work,” said Susman Godfrey partner Arun Subramanian, who, along with partner Jacob W. Buchdahl, served as co-lead trial counsel for Globus Medical.

Added Buchdahl, “This verdict demonstrates that juries are able to see through appeals to local prejudice and reach the merits of a lawsuit.”

Globus was also represented by S. Calvin Capshaw of Capshaw DeRieux LLP.

The Susman Godfrey trial team also included associates John P. Lahad and Mark Hatch-Miller.

In December, Buchdahl, Subramanian and Hatch-Miller co-wrote an article for The Corporate Counselor (an ALM Publication) about their experience trying this case out of their home state and give useful tips about winning ‘on the road.’ Click here to read that article, page 9,
